1. Introduction

Welcome to AIMind ("we," "our," or "us"). These Terms of Service ("Terms") govern your access to and use of the AIMind application, including any updates, new versions, additional features, and all services related to the application (collectively, the "Service").

By downloading, installing, or using our Service, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Service.

2. Description of Service

AIMind is an Android application that allows users to create, edit, import, and export mind maps. The application offers AI-powered features to assist with mind map creation and modification for subscribed users. All mind maps are stored locally on your device.

2.1 Basic Features

All users have access to the following features:

Creating and editing mind maps
Importing mind maps in various formats (FreeMind, XMind, Markdown)
Exporting mind maps in various formats (FreeMind, Markdown, PDF, JPEG)
Organizing mind maps with categories and tags
Adding multimedia content and LaTeX formulas to mind maps

2.2 Premium Features

Users who purchase a subscription gain access to AI-powered features, including:

AI assistance for adding new nodes
AI assistance for editing node content
AI assistance for deleting nodes
Voice and text input for AI requests

3. User Accounts

3.1 Account Creation

To access certain features of our Service, you may need to create an account. You can register using an email address and password or through Google Sign-In. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

3.2 Account Security

You are responsible for safeguarding your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account. We cannot and will not be liable for any loss or damage arising from your failure to comply with this section.

3.3 Two-Factor Authentication

We offer two-factor authentication as an optional security feature. We encourage you to enable this feature to enhance the security of your account.

4. Subscriptions and Payments

4.1 Subscription Plans

We offer subscription plans that provide access to premium features. Details of available subscription plans, including pricing and features, are available within the application.

4.2 Payment Terms

All payments are processed through Google Pay. By subscribing to a premium plan, you authorize us to charge the applicable fees to your selected payment method. Subscription fees are billed in advance on a recurring basis, depending on the subscription plan you select.

4.3 Cancellation and Refunds

You may cancel your subscription at any time through your Google Play account settings. Upon cancellation, you will continue to have access to premium features until the end of your current billing period. We do not provide refunds for partial subscription periods.

5. User Responsibilities and Prohibited Activities

5.1 Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to use the Service:

In any way that violates any applicable federal, state, local, or international law or regulation
To transmit any material that is defamatory, obscene, invasive of another's privacy, hateful, or otherwise objectionable
To engage in any conduct that restricts or inhibits anyone's use or enjoyment of the Service

5.2 Prohibited Activities

You agree not to:

Use the Service in any manner that could disable, overburden, damage, or impair the Service
Attempt to gain unauthorized access to the Service, user accounts, or computer systems or networks connected to the Service
Use any robot, spider, or other automatic device, process, or means to access the Service for any purpose
Introduce any viruses, Trojan horses, worms, logic bombs, or other harmful material to the Service
Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the Service

6. Intellectual Property Rights

The Service and its original content, features, and functionality are and will remain the exclusive property of AIMind and its licensors. The Service is protected by copyright, trademark, and other laws of both the United States and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.

6.2 Your Content

You retain all rights to the mind maps and other content you create using our Service. By using our Service, you grant us a limited license to store and process your content solely for the purpose of providing the Service to you.

7. Termination

7.1 Termination by You

You may terminate your account at any time by following the instructions in the application or by contacting us.

7.2 Termination by Us

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms.

7.3 Effect of Termination

Upon termination, your right to use the Service will immediately cease. Since mind maps are stored locally on your device, you will retain access to your mind maps even after termination, but you will no longer have access to premium features if you had a subscription.

8. Disclaimers and Limitations of Liability

8.1 Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE SERVICE IS FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

8.2 Limitation of Liability

IN NO EVENT WILL WE, OUR AFFILIATES, OR THEIR LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS, OR DIRECTORS BE LIABLE FOR DAMAGES OF ANY KIND, UNDER ANY LEGAL THEORY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, INCLUDING ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO, PERSONAL INJURY, PAIN AND SUFFERING, EMOTIONAL DISTRESS, LOSS OF REVENUE, LOSS OF PROFITS, LOSS OF BUSINESS OR ANTICIPATED SAVINGS, LOSS OF USE, LOSS OF GOODWILL, LOSS OF DATA, AND WHETHER CAUSED BY TORT (INCLUDING NEGLIGENCE), BREACH OF CONTRACT, OR OTHERWISE, EVEN IF FORESEEABLE.

9. Governing Law and Dispute Resolution

These Terms and your use of the Service shall be governed by and construed in accordance with the laws of the jurisdiction in which we operate, without regard to its conflict of law provisions.

Any dispute arising from or relating to these Terms or your use of the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except that each party retains the right to seek injunctive or other equitable relief in a court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of a party's copyrights, trademarks, trade secrets, patents, or other intellectual property rights.

10. Changes to Terms

We may revise these Terms from time to time. The most current version will always be posted on our website and within the application. If a revision, in our sole discretion, is material, we will notify you through the application or via the email associated with your account. By continuing to access or use our Service after revisions become effective, you agree to be bound by the revised Terms.
